Please note that regardless of whether you use the web interface to make purchases or register, you must comply with the following rules, which define and specify the terms of use of all functional components of the web interface.

1. REGISTRATION ON THE WEB INTERFACE

You may register on the Web Interface using the registration form available on the Web Interface. You must fill in the registration form with the required information, in particular your first name, last name, company name, telephone or mobile number and contact e-mail. By registering, a user account is created.

A username and password are required to access the user account. Keep the user account access details confidential. Our company is not responsible for any misuse of the user account by a third party.

The information provided during registration must be true and complete. We may cancel an account that was created using false or incomplete information without refund.

In the event of changes to your details, we recommend that you amend them in your user account without delay.

You can primarily order goods, track orders and manage your user account via your user account. Any additional functions of the user account are always listed on the web interface.

Please note that we are entitled to cancel your user account without refund if there is a violation of good morals, applicable law or these terms of use via your account.

2. PRIVACY POLICY

You provide us with some of your personal data when you fill in an order or register on the web interface. Furthermore, when using the web interface, other data to which we have access is collected, stored and processed. By entering your personal data and using the web interface, you consent to the processing and collection of your personal data to the extent and for the purposes set out below, until you object to such processing. The protection of personal data is very important to us. Therefore, when handling personal data, we act in accordance with the legal order of the Czech Republic, in particular Act No. 101/2000 Coll., on the protection of personal data (hereinafter referred to as the "Personal Data Protection Act"), as amended, and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (General Data Protection Regulation or GDPR).

2.1 What is personal and other data?

Personal data is the data that you voluntarily provide to us as part of completing an order or registration. Personal data means any information that identifies or can identify a specific person. Personal data includes, but is not limited to, first and last name, address, registration number, VAT number, telephone number, e-mail.
Other data, which we obtain automatically in connection with the use of the web interface, are IP address, type of browser, device and operating system, time and number of accesses to the web interface, information obtained through cookies and other similar information. Please note that we may collect this additional data without registration and regardless of whether you make a purchase on the web interface or not.

2.2. The data controller is POKORNÝ spol. s r. o., with registered office at Trnkova 115, Brno, 62800, ID No. 46983864, registered in the Commercial Register maintained by the Regional Court in Brno, Section C, Insert 8469.

2.3. What personal data does POKORNÝ, spol. s r.o. collect and process? POKORNÝ, spol. s r.o. collects and processes the following common personal data: basic identification data and contact data of our customers, i.e. name, surname, title, address, ID number, VAT number, telephone, e-mail. POKORNÝ, spol. s r.o. does not process personal data of children under the age of 13.

**2.4. For what purposes does POKORNÝ, spol. s r.o. use and process personal data? POKORNÝ, spol. s r.o. processes personal data without the consent of clients for the purpose of fulfilling a legal obligation, contract negotiation and contract performance and for the legitimate interest of the data controller (direct marketing of own products, sending commercial communications). Personal data is processed in electronic form by means of computer technology or in paper form.

**2.5 How long does POKORNÝ, spol. s r.o. process the data? POKORNÝ, spol. s r.o. processes personal data, depending on the purpose, for the duration of any contractual relationship and for a further 10 years after the termination of the last contractual relationship with POKORNÝ, spol. s r.o. or until consent to data processing has been withdrawn.

2.6 Do we have to provide personal data to POKORNÝ, spol. s r.o.? The provision of personal data is voluntary, as is the conclusion of a contract with POKORNÝ, spol. s r.o. However, some data are necessary for the fulfilment of legal obligations when concluding a contract for the supply of goods or services and without some data POKORNÝ, spol. s r.o. cannot provide the requested supply of goods or services.
The data necessary for the above are: name and surname if it is a natural person, also his/her business name, distinctive supplement or other designation, registered office and, if applicable, delivery address for goods, telephone, e-mail address.

**2.7 How does POKORNÝ, spol. s r.o. ensure the protection of personal data? Personal data is under constant physical, electronic and procedural control and POKORNÝ, spol. s r.o. has control, technical and security mechanisms to ensure maximum protection of the processed data against unauthorised access or transmission, against loss or destruction, as well as against other possible misuse.
All persons who come into contact with the personal data of clients in the course of their work or contractual duties are bound by a contractual obligation of confidentiality.

**2.8 To whom does POKORNÝ, spol. s r.o. provide or transfer personal data? POKORNÝ, spol. s r.o. transmits personal data to state authorities if this obligation is stipulated by law and if it is necessary for the protection of the rights of POKORNÝ, spol. s r.o. POKORNÝ, spol. s r.o. may delegate the processing of data to a third party, the so-called processor. The processing is only possible on the basis of a contract which obliges the processor to the same level of data protection as provided by POKORNÝ, spol. s r.o. itself.

2.9 What are your rights in relation to the processing and transfer of personal data? You can exercise your rights as a data subject in accordance with applicable legislation. You have the right to access the personal data we process about you, the right to have selected personal data transferred directly to another controller and the right to request the rectification of personal data. You may request the erasure of personal data or the restriction of its processing, unless it is no longer necessary to process it to comply with legal obligations or if it is necessary for us to continue to provide you with services. You can exercise these rights in person at our registered office, in writing to our registered office or by email to gdpr@tesneni.cz .

2.10. What are your options to restrict the processing and transfer of personal data? In the event that POKORNÝ, spol. s r.o. processes personal data on the basis of your consent, you may withdraw this consent at any time. If your data is processed on the basis of a legitimate interest, you may object to such processing. We will evaluate any such objection and inform you of the outcome. 2.12. Who supervises the protection of personal data? 3. GOOGLE ANALYTICS AND COOKIES

The web interface uses Google Analytics, provided by Google, Inc. ("Google").

3.1 What is Google Analytics? Google Analytics uses "cookies", which are text files stored on the computer of each visitor to the web interface, to enable an analysis of how the web interface is used.
The information generated by the cookie about your use of the site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purposes of evaluating the use of the web interface and compiling reports on the activity of its users for us and for the use of the internet in general. Google may also disclose this information to third parties if required to do so by law or if such third parties process this information for Google. Google will not associate the IP address of the subject with any other data held by it.
By using the web interface, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

3.2 Can you prevent the storage of cookies on your computer? You can refuse the use of cookies by selecting the appropriate settings in your browser.
Please note that if you refuse the use of cookies, you may not be able to use the full functionality of the web interface.

4. COPYRIGHT PROTECTION

The content of the web pages hosted on the web interface (text, photographs, images, logos, etc.), including the web interface software and these terms and conditions, is protected by our copyright and may be protected by other rights of others. You may not modify, copy, reproduce, distribute or use the content for any purpose without the permission of our company or the copyright holder. In particular, the free or paid access to photographs and texts placed on the web interface is prohibited.

The names and designations of products, goods, services, companies and companies may be registered trademarks of their respective owners.

**4.1 What are the ways in which we will deal with copyright infringement? In the event of non-compliance with the prohibition described above, we will proceed in accordance with Act No. 121/2000 Coll., Copyright Act, as amended. In particular, our company, as the copyright holder, has the right to demand that infringements of our copyrights be refrained from and to demand the withdrawal of unauthorized copies of protected content.
Furthermore, we have the right to demand reasonable compensation for the damage caused.

5. OTHER RELATIONSHIPS RELATED TO THE USE OF THE WEB INTERFACE

5.1 Please note that clicking on certain links on the web interface may cause you to leave the web interface and be redirected to third party websites.

5.2 Our company shall not be liable for errors resulting from third party intervention in the web interface or from its use contrary to its intended use. When using the Web Interface, you must not use mechanisms, software, scripts or other procedures that could adversely affect its operation, i.e. in particular interfere with the function of the system or place an unreasonable load on the system, and you must not take any action that could enable you or third parties to interfere with or make unauthorised use of the software or other components that make up the Web Interface or use the Web Interface or parts thereof or the software in a manner that is contrary to its purpose or intent.

5.3 We cannot guarantee uninterrupted access to the Web Interface or the integrity and security of the Web Interface. We shall not be liable for any damage caused in the course of accessing and using the web interface, including any damage caused by downloading data published on the web interface, damage caused by interruptions in service, malfunction of the web interface, computer viruses, damage due to loss of data, profit or unauthorised access to transmissions and data.

5.4 If you commit any illegal or unethical act while using the web interface, we are entitled to restrict, suspend or terminate your access to the web interface without any compensation. In this case, you shall furthermore be obliged to reimburse our company in full for any damages that have been proven to have been caused by your conduct pursuant to this paragraph.
